No.: 0141317415, First Niagara (Pittsburgh, PA), ABA Routing No.: 222 370 440. You are urged to inspect before the sale. Removal of items by insured riggers only. Although information has been obtained from reliable sources, the Auctioneer makes no warranty or guarantee, express or implied as to the accuracy of information in this brochure. Payments by check require a seven business day holding period before related equipment can be removed. International buyers must pay in cash or wire transfer. All purchases must be removed within period announced by Auctioneer. All descriptions are believed to be correct, but no guarantees or warranties are made by Auctioneer as to nomenclature or age. Everything sold on an “as is, where is and with all faults” basis.
 
We are required to collect GST/HST taxes totalling 13%. This will be added to your invoice.
 
TERMS OF REMOVAL.
1) PURCHASER’S RISK. All purchases made at this sale are at the purchaser’s risk as soon as they are announced sold by the Auctioneer.  The Auctioneer and principal(s) shall have no liability for any loss or damage to items for any reason whatsoever once announced sold.
 
2) CLAIMS. No claims will be allowed after removal of goods from the sale premises.
 
3) AUCTIONEER AND PRINCIPAL(S) LIABILITY.  Auctioneer shall not, in any event, be liable for non-delivery or for any other matter or thing, to any purchaser of any lot, other than for the return to the purchaser of the deposit or sum paid on said lot, should the purchaser be entitled thereto. Neither the Auctioneer nor its principal(s) shall be held liable with respect to any item sold in any greater amount than that paid by the purchaser and, in all instances, the highest bid shall be accepted by both the buyer and principal(s) as the value against which all claims for loss or damage shall lie.
 
4) Removal of all items shall be at the expense, risk and liability of the purchaser. During the auction sale and during removal of items, the purchaser assumes all risk of damage and/or loss to person and property and specifically releases M. Davis Group, LLC, Gordon Borthers Commercial & Industrial, LLC, Aquablue Spring Water International Inc. and Hershey Canada Inc. from liability, therefore.  Purchaser will indemnify and protect M. Davis Group, LLC, Gordon Borthers Commercial & Industrial, LLC, Aquablue Spring Water International Inc. and Hershey Canada Inc. from all claims of purchaser’s agents, employees, invitees and all other persons brought or invited to the auction premises by the purchaser for the purpose of purchase or removal of auction items. M. Davis Group, LLC, Gordon Borthers Commercial & Industrial, LLC, Aquablue Spring Water International Inc. and Hershey Canada Inc. shall not be liable by reason of any defect in or condition of the auction premises.
 
5) Purchasers of items requiring the use of forklifts, cutting implements or rigging equipment, must furnish to M. Davis Group, LLC an original insurance certificate naming M. Davis Group, LLC, Gordon Borthers Commercial & Industrial, LLC, Aquablue Spring Water International Inc. and Hershey Canada Inc. as additional insureds in the amount of at least $2,000,000 of liability insurance prior to commencing any removal activity.
 
6) Liable for Damages - Any surface or structural damage to walls, ceilings, floors, overhead doors, gates or other areas created during removal is the responsibility of the buyer.  In the event of damage, Buyers and their Riggers will not be permitted to leave with equipment until repairs are made.

It is the responsibility of the winning bidders to arrange for the rigging/removal of their purchases. Removal of all purchased items are at the expense, risk and liability of the purchaser. M. Davis Group, LLC and Gordon Brothers Commercial & Industrial, LLC take no responsibility for such rigging/removal. The following rigging companies can assist you in the rigging/removal of your purchased items (M. Davis Group, LLC and Gordon Brothers Commercial & Industrial, LLC have no interest in these entities and merely provide these contacts as a convenience):
