Full payment day of sale in guaranteed or certified U.S FUNDS. Company check accepted with letter of approval from your bank. Direct wire transfers to the escrow account of M. Davis Group, LLC accepted ONLY with prior arrangement. You are urged to inspect before the sale. Removal of items by insured riggers only. Although information has been obtained from reliable sources, the Auctioneer makes no warranty or guarantee, express or implied as to the accuracy of information in this brochure. Additional terms to be announced at sale. Absentee bidding is also available.

Payments by check require a seven business day holding period before related equipment can be removed. International buyers must pay in cash or wire transfer. Everything sold on an “as is, where is and with all faults” basis.

All purchases made at this sale are at the purchaser’s risk as soon as they are announced sold by the Auctioneer.  The Auctioneer and principal(s) shall have no liability for any loss or damage to items for any reason whatsoever once announced sold.

No claims will be allowed after removal of goods from the sale premises.

Auctioneer shall not, in any event, be liable for non-delivery or for any other matter or thing, to any purchaser of any lot, other than for the return to the purchaser of the deposit or sum paid on said lot, should the purchaser be entitled thereto. Neither the Auctioneer nor its principal(s) shall be held liable with respect to any item sold in any greater amount than that paid by the purchaser and, in all instances, the highest bid shall be accepted by both the buyer and principal(s) as the value against which all claims for loss or damage shall lie.

All contracted riggers and movers must have an insurance certificate on file with M. Davis Group, with a minimum of $2,000,000.00 in liability and damage coverage. Please name M. Davis Group and Dean Foods as additional insured. Email a copy of the Insurance Certificate to .(JavaScript must be enabled to view this email address) prior to removal of equipment, or fax it to (412) 871-5613.

Buyer acknowledges and agrees that by placing a bid on an asset, Buyer represents and warrants: (1) that it shall not misrepresent its ability to close the transaction pursuant to the terms and conditions of sale, and in accordance with these terms, (2) that the Buyer has the capacity and intention to close the transaction, and (3) that Buyer has actual authority to enter a bid, and to enter into an agreement to purchase the asset and (4) that any bid that it makes on an item constitutes an irrevocable offer to buy the item for the full amount of the bid. Buyer acknowledges and agrees that it shall be responsible for the payment of all amounts owed for a winning bid including but not limited to applicable taxes and Buyer’s Premiums.

It is the responsibility of the winning bidders to arrange for the rigging/removal of their purchases. Removal of all purchased items are at the expense, risk and liability of the purchaser.  M. Davis Group and Theo’s Foods bear no responsibility for such rigging/removal.
